Equipment Usage AGREEMENT for Alice Springs Equestrian Management Group Equipment Hire 2020

INTRODUCTION Equipment hire is a service offered by Alice Springs Equestrian Management Group (ASEMG) to assist with club member’s development.

Importantly, hire is only available to members of Alice Springs Equestrian Management Group (ASEMG).

Hire of equipment is on a first come, first served basis, which may result in delays in obtaining equipment during peak demand.

The below agreement outlines the terms and conditions associated with hiring resources from Alice Springs Equestrian Management Group (ASEMG).

HIRER’S

It will be the hirer’s responsibility to:

RESPONSIBILTIES

 Agree to wear an Equestrian Australia (EA) approved helmet and relevant safety equipment at all times whist mounted;

 Abide by the Alice Springs Equestrian Management Group "Code of Conduct" at all times;

 Agree to abide by the rules and by-laws as set out in the Constitution, By-laws, Rule Books and Publications;

 Pay hire charges before loaning the equipment and notify the club delegated representative prior to use;

 No parking of floats in the Alice Springs Equestrian Management Group (ASEMG) delegated area;

 Operate, maintain and store the equipment strictly in accordance with any instruction provided by Alice Springs Equestrian Management Group (ASEMG), with due care and diligence, only for its intended use whether supplied by Alice Springs Equestrian Management Group (ASEMG) or posted on the appropriate website;

 Unless prior agreement is made between the hirer and the club delegated representative no equipment is to be removed from the Alice Springs Equestrian Management (ASEMG) delegated area;

 Maintain the equipment in reasonable condition, clean the equipment/arena thoroughly of all manure at completion of use;

 Pack away all Show Jumping equipment at completion of use, unless otherwise stipulated by club representative;

 The equipment will only be used by the hirer, and will only be used for its intended purpose;

 Not re-loan the equipment nor conduct paid coaching sessions, or unauthorised competition, sell, assign, sub-let, lend, pledge, or hire the equipment without Alice Springs Equestrian Management Group (ASEMG) permission; and

 Assume any loss or damage to the equipment (fair wear and tear excluded) during the hire period.

If there is a breakdown or failure with the equipment, the hirer must notify Alice Springs Equestrian Management Group (ASEMG) and not attempt to repair the equipment.

LOAN PERIOD

The maximum loan period is one calendar year. The hiring of the equipment will commence from the commencement date specified in the schedule attached and continue for the term specified in the schedule.

TERMINATION OF AGREEMENT

Alice Springs Equestrian Management Group (ASEMG) may terminate this agreement:

 At any time by giving the hirer 24 hours’ notice of such intention to terminate; and

 Without notice if the hirer commits a breach of any terms of this agreement, or if a winding-up petition is presented against the hirer, or if the hirer goes into liquidation or bankruptcy.

Alice Springs Equestrian Management Group (ASEMG) will only charge the hire fee up to and including the time or repossession.

LIABILTY

The hirer accepts full responsibility for and indemnifies Alice Springs Equestrian Management Group (ASEMG) against all claims in respect of any injury to persons, or loss or damage to property arising out of delivery, servicing, storage, possession or use of the equipment during the hire period however arising, whether arising from your negligence or agents and without limiting the forgoing whether or not the equipment was being operated by you or your agent.

To the extent permitted by law, the owner disclaims all liability for and does not give any warranties to the hirer as to the condition of the equipment.
