Terms and Conditions of Solo Select Spring Spectacular Online Sale

1. Introduction

Welcome to The NSW Cutting Horse Club Solo Select Spring Spectacular Online Auction. These Terms and Conditions of Sale govern all purchases made through this online platform. By participating in the auction or making a purchase, you agree to be bound by these Terms.

If you do not accept these Terms, you must not bid on these products and services.

2. Eligibility to Bid

• You must be at least 18 years old and legally capable of entering a binding contract to register and participate in our auctions.
• We reserve the right to verify your identity and refuse access to our services at our sole discretion.

3. Registration

• All bidders must register for an account before placing a bid.
• You are responsible for maintaining the confidentiality of your account details and for all activity under your account.
• You must ensure that all information provided is accurate and up to date.

4. Bidding Process

• Bids are final and legally binding. Placing a bid constitutes an offer to purchase the item at the bid amount.
• Bidding may be subject to a reserve price, which is the minimum price the seller is willing to accept. If the reserve is not met, the item may not be sold.
• We reserve the right to extend, pause, or cancel an auction at our discretion due to technical issues or other unforeseen circumstances.

5. Winning Bids and Payment

• The highest bid received at the close of an auction (provided it meets or exceeds any applicable reserve price) will be deemed the winning bid.
• The winning bidder will receive a confirmation email  and Tax Invoice and is required to pay the full amount, including GST, within 48 hours of auction close.
• Payment must be made via direct deposit OR electronic bank transfer.
• Failure to make payment may result in cancellation of the sale, suspension of your account, and/or legal action.

6.  Taxes

• All prices shown are in Australian Dollars (AUD). GST will be added to final purchase price.

7. Delivery and Pickup

• Stallion contracts will be forwarded to your email account once payment has been received. The successful purchaser will then converse directly with the Australian Agent for the Stallion, Healy Quarter Horses.
• All other items purchased must be collected directly from the business who has donated the item.

8. Returns and Refunds

• All sales are final unless otherwise stated.
• No refunds will be given for change of mind or bidder error.
• If an item is materially misrepresented or faulty, please contact us within 14 days of receipt. We will assess claims on a case-by-case basis in accordance with Australian Consumer Law.

9. Seller Warranties

• Items are sold on an “as-is” basis unless otherwise described.
• We do not warrant the accuracy of item descriptions provided by sellers, although we take reasonable steps to ensure accuracy.

10. Limitation of Liability

• To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential loss arising out of or in connection with the auction or sale of any item.
• Our liability for breach of any consumer guarantee under the Australian Consumer Law is limited, at our discretion, to the replacement, repair, or refund of the item.

11. Prohibited Conduct

• You must not engage in shill bidding, bid manipulation, or fraudulent activity.
• We reserve the right to suspend or terminate your account if we believe you are acting in breach of these Terms or applicable laws.

12. Privacy

Your personal information is handled in accordance with standard Australian Privacy Policy, and in compliance with the Privacy Act 1988 (Cth).

13. Amendments

We may update these Terms from time to time. Continued use of our services after any changes constitutes your acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of New South Wales. Any disputes arising shall be subject to the exclusive jurisdiction of the courts of that State or Territory.
